Terms of Service

Liability:

     Flight instruction is inherently dangerous. Therefore, when learning to fly you agree to hold the instructor, his associates, his family and his companies harmless for any injury or death that results during the course of your training whether or not he is present at the time of the incident or accident.

Payment for Services:

     The rate for flight instruction may vary based on the type of instruction and the equipment used. In any case the current rate will not be less than $60.00 per hour for the instructor.

     The student will be responsible for providing the vehicle in which to train. If this vehicle includes a rental vehicle, the student is responsible for all costs involved at the time of instruction and based on the terms of the company renting the vehicle. At no time will the instructor be responsible for the costs incurred through the use of a rental vehile or equipment.

     If the vehicle or other equipment is owned by the student or an associate of the student, the student is responsible for ensuring the vehicle or equipment is in safe and workable condition. The equipment must be maintained in safe and workable condition throughout the course of instruction. In the case of an aircraft, it must be proven that the aircraft is airworthy and meets all FAA requirements for flight prior to instruction. This includes the completion of all required inspections and maintenance. Any costs incurred in order to meet this requirement is the responsibility of the student and/or the student's associates. In no case will the instructor be held responsible for maintenance, repairs or inspections of equipment.

     Payment in full for services is due at the end of each lesson. If, by the decision of the flight instructor, an exception is made to this rule for any reason, either on a one time or recurrent basis, it does not constitute an alteration or modification to these Terms of Service or to the signed agreement made when instruction began.

Charges Incurred:

     Charges for instruction are on an hourly basis. In most cases the same rate is applied to flight instruction as well as ground instruction. Charges are based on the type of aircraft being flown and the rating being sought. If equipment must be rented these rates will be handled directly by the student unless prior arrangements are made with the instructor.

     In the case of flight instruction charges are based on a hobbs meter reading when installed on the aircraft. In any case, charges cover all times when at least one engine is running and may also include fifteen minutes prior to engine start and fifteen minutes after shut down of last engine when ground instruction is being given just prior to and just after flight instruction.

     Charges for flight and ground instruction will be agreed upon by the instructor and student prior to beginning of flight instruction. Because people learn at different rates it is difficult to determine the cost of flight instruction for a given rating. The FAA required minimum flight and ground times are a good starting point for estimating total instruction cost but it must be understood that these are bare minimums for a given rating. In general students require more instruction than the minimum in order to become proficient and pass the FAA required testing. Your instructor will go over estimated duration and cost of flight instruction before training begins. It must be understood that any quotes given are estimates and subject to change based on student ability, weather and other uncontrollable factors.

Insurance Requirements:

     Insurance is the responsibility of the customer if training is to occur in customer-owned equipment. It must be assured that the instructor pilot is added to the customer's insurance policy for the training. This insurance must include liability and whole loss coverage. Contact your broker for details. PROOF OF INSURANCE IS REQUIRED PRIOR TO BEGINNING FLIGHT INSTRUCTION. If the equipment is rented, the student will need to contact the rental company regarding insurance coverage. In most cases the liability and loss coverage will be provided by the rental company. Any additional insurance desired will generally be the responsibility of the student.

Flight Training:

     Flight training will not exceed eight hours per twenty-four hour period as per the Federal Aviation Administration regulations.

Aircraft Airworthiness:

     In the case of training in the customer's own aircraft, it is the responsibility of the owner/customer to ensure that the aircraft is in an airworthy condition prior to training. This includes any modifications made to the aircraft. All required inspections such as annual, 100 hour, altimeter/static, transponder, airworthiness directives, etc. must be current and maintained.
     If it is determined by the instructor pilot that the aircraft is not airworthy during the preflight inspection of the aircraft then the aircraft will be grounded until it is brought to an airworthy condition. Any work required to make the aircraft airworthy will be the responsibility of the customer.

Unforeseen Delays:

     Many circumstances may arise that delay instruction. The instructor cannot be held responsible for mechanical problems, weather delays or cancellations resulting from equipment or weather. In most cases where flight instruction cannot be completed on a given day alternative training may still be possible such as ground training or testing. The student will not be held responsible for weather delays or cancelations. The student will not be held responsible for mechanical issues on rental equipment provided the damage or issue is not caused by the student. The student may be held responsible for the instructor's time involved for last minute cancelations (less than 24 hours notice) of instruction. Prior arrangements should be made as soon as it becomes known that the student will not be able to make a lesson. No-shows may be billed at a flat one and one-half hour rate.
